DARIUSZ DĄBEK

Counsel. Darek specializes in electronic communications sector regulations and digital services (including EECC, DSA, AI Act, NIS2). He possesses extensive experience in legislative processes and strategic management within the public and research sectors. As the Deputy Director of the Telecommunications Department at the Ministry of Digital Affairs, he led efforts to shape national and EU legal frameworks for the digital market, including the substantive preparation of key statutory amendments, regulations, and government positions in EU legislative processes. Subsequently, as the Director of the National Institute of Telecommunications – the State Research Institute, he managed the implementation of tasks concerning strategic state services and technological infrastructure, while exercising overall supervision over the institution’s operations.

EXPERIENCE

Representation in arbitration proceedings concerning the protection of foreign investments (BITs);
Representation of clients in administrative and judicial-administrative proceedings concerning the compulsory restructuring of banks domiciled in Poland;
Representation of one of the largest insurance companies in arbitration and post-arbitration proceedings related to the comprehensive implementation of an IT system;
Managed tasks related to the support, monitoring, and operational continuity of systems of strategic importance, including Starlink satellite communications infrastructure and e-Toll system components;
Substantive development and coordination of legislative work on amendments to the Telecommunications Law (specifically in spectrum management, telecommunications confidentiality, obligations related to national defense and security, premium rate services, and contracting regulations);
Conducted high-level EU negotiations regarding net neutrality (TSM), data protection (GDPR), and privacy (e-Privacy);
Representation of a major investor in long-term arbitration and post-arbitration proceedings against an office space tenant;
Developed and supervised the implementation of executive acts in telecommunications (e.g., national numbering plans, spectrum selection procedures, technical standards for receiving equipment, and accessibility for persons with disabilities);
Led the implementation of EU directives (e.g., RED, EMC) into the national legal order and provided expert opinions on draft regulations and positions regarding the national cybersecurity system (NIS/KSC);
Representation of a foreign railway carrier in a landmark dispute against the State Treasury, related to a judgment of the Court of Justice of the European Union (CJEU) finding incorrect implementation of an EU directive;
Substantive coordination of market consultations preceding the implementation of the SMS emergency notification system (currently known as “Alert RCB”);
Served in advisory capacities, including the ICANN Governmental Advisory Committee and the Scientific Council of the National Institute of Telecommunications – the State Research Institute.
